Facebook Reach Trademark Dispute Settlement

At noon on May 27th, Beijing time, according to the well-known American technology blog, Facebook has reached a conciliation of trademark disputes between Mark CEO Mark (Mark Zuckerberg) and Harvard classmate Aaron Greenspan (Aaron Greenspan). The industry believes that the move can remove obstacles for the company's listing.

In July 2006, Greenspan filed an application with the US patent and Trademark Office for the cancellation of "Facebook", "Face Book", "Universal Face Book" and "Face Net" owned by Facebook.

After that, Greenspan always claimed that Zuckerberg had stolen his Facebook concept, and Facebook was named after their project named "the Face Book" in 2003.

According to the industry, Greenspan lacks the experience of litigation, because according to the civil media law course of Harvard University, "trademark is a symbol, marker or indicator used by individuals, enterprises or organizations to identify a product or service, and distinguish it from competing products or services."

Generally speaking, an enterprise name can be used as a trademark protected by the federal and State Trademark Law. "

"Trademark law aims to prevent consumers from perplexing trademarks of products and services associated with enterprises or other organizations."

To sum up, in order to achieve protection, trademarks are either distinctive or widely known.

As far as Facebook is concerned, the name was not known in 2003. It was not widely known until 2006. This reputation made Facebook a trademark.

The industry believes that Facebook is willing to reconcile with Greenspan because of its commercial significance rather than fear of losing the case in court.

It not only saves Facebook costs, but also eliminates another obstacle to the listing of the company.
