H&M

The latest case is found in the tort lawsuit.

The federal court of California ruled that H&M infringed the patent of the Unicolors fabric print pattern, and the latter should be compensated for us $846 thousand and 700.

In April last year, Unicolors filed a lawsuit against the federal court of California.

They accused H&M of plagiarizing the patented print pattern on Unicolors's skirt and coat.

Although the case of H&M being accused of infringement is not new, Unicolors is essentially more like a copyright speculator.

About 100 similar lawsuits were filed last year by Unicolors, accused of infringement.

(Note: copyright speculators take very frequent legal actions to protect patents, far beyond the reasonable market value or importance of intellectual property rights).

Earlier, Unicolors filed a lawsuit against the US fashion brand Ivanka Trump (the brand name of the eldest daughter of the US President Trump) and its parent company G-III Apparel in the federal court of Losangeles, claiming that the latter copied their patented print patterns through a jacket sold by a discount retailer TJMaxx, which only invested a small amount in the production and sale, and caused damage to the interests of Unicolors.

In October this year, the two sides reached a settlement.

Other retailers sent to the court by Unicolors include: Nordstrom department store, famous American teenage apparel chain retailer Urban Outfitters Outfitters, and Spanish fast fashion giant Inditex's flagship brand Zara.

Unicolors's litigation is often accused by the accused as "legalized extortion".

Although the two sides are very fierce in legal disputes, few of these copyright cases will be tried because of the cost.

Recently, Unicolors's lawsuit against Urban Outfitters is one of the few cases that have been formally heard.

Finally, the court declared that Urban Outfitters was successful and proved that it had no infringement.

This time, H&M failed.

According to the company, the jury believed that H&M could get the Unicolors fabric design plan and make changes through the supply chain factories shared by both sides.

The jury agreed with H&M's plagiarism of Unicolors.

Although the $850 thousand settlement and the corresponding legal costs will not have a significant impact on the H&M group, which has billions of dollars in business, the decision of the case has set an interesting precedent for the federal court's decision on fashion infringement cases.

Whether H&M will continue appeals or obey the verdict will become the focus of news.
